Criminal Background Check

General Overview
Information by Applicant Type:

Hire/Rehire Guidelines

The Department of Human Resources and Equal Opportunity (HR/EO) determines the eligibility for hire or rehire of individuals seeking employment with the University for staff, and in some cases, student hourly positions. As with any employer, these determinations may be made on the basis of information from the criminal background check process, employment history and/or employment references. Persons denied eligibility for employment may discuss this status with the Director of HR/EO or his/her designee.

Retire Rehire Policy

To be considered for employment:

  • You must apply for a specific, open position for which the University of Kansas is seeking candidates. All required application fields must be completed prior to submittal.
  • You must meet the documented minimum requirements related to the specific position for which you are applying.
  • You must comply with the University of Kansas standard application procedure and provide any required supporting materials as identified on the posting (i.e., curriculum vitae/resume, letter of interest, references, etc.).

Self Disclosure of Criminal History

Applicants applying to University Support Staff, University Professional Staff, and Student Hourly positions will be required to self disclose any history of criminal convictions or pending criminal charges at the time of application. A conviction record is not an automatic bar to employment. The University will determine whether an applicant may be released for interview based upon the information provided, its relevancy to the position sought, and the totality of the circumstances.

Applicants are also to acknowledge (in writing) to the University of Kansas Human Resources and Equal Opportunity (HR/EO) any occurrences or events that take place prior to receipt of a job offer or start date which may render previous self-disclosure statements in your application inaccurate, untrue, or incomplete.

Veracity of Employment Information (to Certify Application)

As an applicant for University of Kansas employment, you will be required to certify the information reflected in your application to be true to the best of your knowledge. Any misrepresentation may result in revocation of a University job offer or may result in discharge, if hired, regardless of when discovered. In the application certification process, you as an applicant, also grant permission to the University of Kansas to investigate employment records, educational records, criminal records, release current or prior KU performance evaluations and/or non-medical work records, etc. to verify the information provided in your application. Such statement releases the University, its agents and persons contacted, from any liability resulting from such investigation. You will also confirm your understanding of being able to provide work eligibility confirmation if offered employment, and that you are subject to the State of Kansas Tax Clearance program, and to uphold the constitution of the U.S. and Kansas (Kansas law 75-4308) if offered employment.

All employment offers or letters generated will be noted as conditional and contingent upon the satisfactory completion of the criminal background check.

A check box serves as your electronic signature and evidence of certification.

Verification of Identity and Work Authorization

Any offer of employment is contingent upon the successful completion of a criminal background check and upon completing the USCIS Employment Eligibility Verification (Form I-9) as well as providing documents to verify your identify and employment eligibility as required by law. When completing the I-9 Form, you will be required to attest that you are a citizen or national of the U.S., a lawful Permanent Resident, or an alien authorized to work.

Family Medical Leave Act

The Family Medical Leave Act (FMLA) is a United States labor law which allows an employee a specific period of leave due to a qualifying medical or military exigency or caregiver leave. FMLA eligibility is determined by the Department of Human Resources and Equal Opportunity (HR/EO) for University of Kansas faculty, academic staff, unclassified professional (UPS), and university support staff (USS) employees.
